Important note: visa wait times are difficult to predict. These wait times depend on government processing speed, annual visa limits, unused visas from previous years, and country demand, all of which change over time.

With that said, EB-5 visa wait times are primarily driven by three separate factors:

  1. USCIS processing of your petition
  2. Availability of a visa number
  3. AOS (Adjustment of Status) vs. Consular Processing

 

In general, the visa timeline is controlled by whichever of these takes longer. Even if USCIS approves a case quickly, an applicant cannot receive a green card until a visa number is available, and visa number availability then depends on country of birth.

After the I-526E has been processed and approved: 

  • Investors who adjusted their status (filed the I-485 petition concurrently) follow I-485 processing from within the U.S.
  • Consular applicants go through the NVC (National Visa Center) and their local U.S. embassy or consulate.

However, none of these override visa limits. If your priority date is not current, a visa cannot be issued until a visa number is available. This is why EB-5 visa wait times can be longer than USCIS processing times alone.

EB-5 Categories

After the Reform and Integrity Act of 2022, EB-5 visas are no longer processed through a single queue.

  • Reserved categories (rural, high-unemployment/TEA, and infrastructure) use set-aside visas.
  • Unreserved filings use the general visa pool.

An investor from India may expect around 12 months as well, but only for a rural set-aside visa. Lastly, an investor from China in an unreserved project could expect at least a 12-month window for I-526E adjudication plus an 8- or 9-year visa wait.

Different Processes

Even when investors in the same project may share the same country of birth, adjustment of status (I-485) moves differently than the consular process. The EB-5 wait times for India reflect heavy filing volume, family size, and demand across all categories. Reserved categories let investors bypass the general backlog through dedicated visa set-asides (20% rural, 10% high-unemployment, 2% infrastructure), so many choose rural projects to reduce delays when appropriate.

China

The EB-5 China wait times reflect long-standing demand. Choosing a reserved category (such as a Rural project) can help, but if too many investors concentrate in one category, delays will return.

Other countries

Although EB-5 wait time for Indians and Chinese generally receive the most attention, investors from most other countries usually see much faster visa issuance, since there are not enough beneficiaries to lead to a backlog.

Urban vs. Rural, AOS vs. Consular

For Urban TEA (or unreserved projects) investors should look more closely at the Visa Bulletin, because more filings and larger families can slow movement in those categories. For Rural projects, investors may benefit from reserved visas and, in some cases, quicker review, especially when demand is still building.

For investors already in the United States, Adjustment of Status (AOS) with concurrent filing can provide work and travel benefits while investors wait, even if the overall EB-5 timeline is still long. For investors processing through a consulate, there is no EAD/AP safety net, so consular steps and local embassy backlogs become part of the total wait time.
