Is It Hard To Get an EB-5 Visa?

The EB-5 visa program is one of the best ways for immigrant investors to gain permanent residency in the US. You need to make the required EB-5 investment and create ten full-time jobs for qualified US employees. Houston EB5 can guide you to meet the investment and job creation requirements, simplifying the process of getting EB 5 visas.

What Is the Process for Getting EB 5 Visas?

Knowing what to do when applying for your visa can save you time, allowing you to get your green card faster. Here are the steps to follow when applying for your visa:

Hire an Immigration Attorney

Hiring an attorney experienced with EB-5 visa applications can save you the hassle of researching the rules relating to the process. We’re willing to work with your legal counsel to make the application process as seamless as possible.

Choose a Regional Center

A regional center is an entity regulated by the US Citizenship and Immigration Services (USCIS) that can pool money from multiple EB-5 investors to fund projects. The right center will give you various investment options, eliminating the need to start your commercial enterprise alone. This can benefit investors with limited business knowledge or those who don’t understand the US economy well enough to identify viable investments.

Houston EB5 has over ten years of experience helping investors get their EB-5 green cards. As a team of immigrants, we understand how daunting the application process can be, so we strive to make the application as easy as possible. You only need to fill out an investor questionnaire to get in touch with us. We’ll then schedule a meeting to discuss the EB-5 application process and how we can help through our projects.

Choose an Investment Project

Our goal is to help you gain permanent residency by offering investment opportunities guaranteed to provide quality returns. We choose low-risk and high-return projects because we’re vertically integrated—this means we’ll only profit from your investment if you do. You can rest assured we’ll do our best to maximize your gains.

We have a 100% project success rate—some of our completed projects include the Arabella, Marlowe, Eighteen25, and Moderno Fund I-XI. Houston EB5 works with DC partners, a reputable real estate development firm, and Moderno Porcelain Works, one of the best surfacing providers in the US. These partners allow us to give you safe, high-return investment options.

Open projects include the Allen, the Frederick, and Moderno Porcelain Works. We can discuss these projects more in-depth during your consultation.

File Form I-526

All standalone investors must file form I-526 to receive EB-5 immigration status. The USCIS requires all applicants to submit three categories of information—personal, financial, and project-related.

You should submit your personal details, copies of your passport, your family members’ passports, past immigration applications, and judgments from criminal or civil lawsuits. The USCIS also requires you to prove you’ve invested the necessary minimum capital ($800,000 in Targeted Employment Areas (TEA) or 1,050,000 in non-TEA areas) or are in the process of doing so.

Applicants should submit financial documents like bank statements, tax return documents, financial statements for all their businesses, copies of business licenses, and proof of business ownership. You should also disclose all your sources of income and provide sufficient evidence proving that the funds you plan to invest in the US were obtained lawfully.

We’ll help you by providing you with the project documentation you need. The documentation will show that your chosen project will meet USCIS’ EB-5 requirements—create at least ten full-time jobs for US workers and invest the necessary minimum capital into the US economy. We can guarantee our projects meet these requirements because we thoroughly assess them before presenting them to our clients. Projects like The Allen have USCIS exemplar approval, so you can enjoy faster processing for your EB-5 application if you choose them.

Visa Processing

You can apply for a conditional visa after USCIS approves your I-526. The conditional visa is valid for two years, within which you can enjoy the same rights as other lawful permanent residents in the US.

To get the conditional visa, you will need to file form I-485 to adjust your status to a conditional permanent resident if you’re residing in the US. If you’re outside the US, you’ll need to file DS-260 to seek admission into the US. The visa allows you to enjoy benefits like the freedom to work, study and live anywhere in the US.

File Form 1-829

Houston EB5 can help you get an unconditional green card 21 months after receiving your conditional visa. We’ll submit evidence showing you’ve invested all the necessary funds, established a new commercial enterprise, sustained the enterprise throughout the two-year conditional period, and created at least ten full-time jobs through your enterprise. Our support can help you, your spouse, and your unmarried children (under 21 years) become green card holders.

Getting EB-5 Visas Is Easy

Getting EB 5 visas can be straightforward if you find the right partners to guide you in your application process. An EB-5 regional center can make the application process easy by giving you viable investment options and providing the documentation you need to prove your chosen investment has met all USCIS’ EB-5 requirements.
