It’s important to note that EB-5 investors from countries facing visa retrogression, like China and India, cannot take advantage in EB-5 concurrent filing unless they invest in a project whose visa category is “Current” in the Visa Bulletin.
If you are from China or India, we urge you to exercise caution. Although the Visa Bulletin may show as “Current” in categories, it’s important to speak with your immigration counsel and regional center to learn the status of existing petitions and the risk of retrogression in the respective EB-5 category.
